fourth amendment repealed 10 more years!



earlier this week, in light of the most recent set of bombings in London, the US house of representatives voted to renew certain parts of the USA PATRIOT Act 2001(Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001 [bloody incredible how legislators always think up the best acronyms, isnt it?]) for ten more years.

i dont really know where i stand on this. i mean, i can see how the patriot act can be a useful tool in fighting terrorism, but what concerns me is Provision 213 of the patriot act which states: "surreptitious search warrants and seizures upon a showing of reasonable necessity and eliminates the requirement of Rule 41 of the Federal Rules of Criminal Procedure that immediate notification of seized items be provided." in a nutshell, that provision states that authorities can bust your door down, search your house, take what they want, wire tap your phone conversations, electronically monitor you, and all that stuff all based on probable cause that you might be a terrorist. hell, they dont even have to tell you that theyve searched your house or that youve been monitored. that seriously goes against the fourth amendment to the United States Constitution, which protects against unlawful searches and seizures, and requires the use of a search warrant in order to do so.

doesnt that strike you as just a little bit unconstitutional?

i mean, it sounds like all i'd have to say is 'i hate america and i wanna move to canada' and that would be just cause for authorities to keep taps on me.

another thing that worries me is Provision 215, which makes things like your medical records, bank records, travel records, hell, even things like which books youve checked out from the public library or movies youve rented from blockbuster, available to authorities again, on suspicion that you might be a terrorist. and just like provision 213, you dont (and in this case, *wont*) have to be told that authorities have accessed said records. i guess it just worries me that the government has access to documents saying that i have acute asthma, or that i rent a lot of anime from hollywood video. have you ever read the George Orwell book 1984? im afraid thats what things are turning into. you had better be careful what you say, because big brother is watching YOU!

now, im conservative when it comes to politics, and i love my country very much, no matter what she gets herself into. terrorism outrages me, and i support why our troops are fighting in the middle east. i guess having said that, it doesnt make a whole lot of sense jsut why i'm not 100% for the patriot act. its the whole 'probable cause' thing that gets me. my privacies can be violated basically on the grounds that because i have views that differ from other people, some may consider me to be unpatriotic, or a terrorist of sorts. i jsut think there needs to be more than a suspicion involved in order to investigate such things.

i suppose i'd better say 'god bless america' before i get wire-tapped...
